Michael Trkulja won a court battle on Wednesday for the right to sue Google for defamation. Trkulja was shot in the back at a Melbourne restaurant in 2004, and is claiming that search results for his name indicate he is "associated with the Melbourne criminal underworld."
Trkulja's lawyers argue that Google has defamed him by publishing photos of him linked to Australian criminals, and that autocomplete options associated with his name include "former hit man," ''criminal" and "underworld."
Google is arguing it would be "irrational" for someone to assume every image in a search result is factual, pointing to movies and actors.
The Australian High Court unanimously agreed with Trkulja, adding another chapter to a length legal dispute. The case is now expected to return to the Victoria Supreme Court for trial.
"I'm not a criminal..I will make sure these people are not going to ruin my family." commented Trkulja.
